Terms of Use
1. Acceptance
By accessing or using empwrdpatient.com (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site. EMPWRD Patient is operated by Matt Toresco, LLC ("EMPWRD Patient," "we," "us," "our").
2. What the Site is
The Site is informational. It tells you about the EMPWRD Patient app, the EMPWRD Patient Collective, the EMPWRD Framework, and our approach to patient self-advocacy. The Site lets you join early-access lists and receive updates.
The Site is not the EMPWRD Patient app. The app — available at empwrdpatient.app — has its own terms of service.
3. Not medical advice
The Site is not a substitute for professional medical advice, diagnosis, or treatment. Nothing on the Site is intended to diagnose, treat, cure, or prevent any disease or condition.
If you are dealing with a medical issue, talk to a qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of something you read on the Site.
In an emergency, call 911 (in the US) or your local emergency number.
4. Acceptable use
You agree not to use the Site to:
- Submit false, misleading, or fraudulent information
- Harvest contacts or personal information about other users
- Probe, scan, or test the vulnerability of the Site without our written permission
- Interfere with or disrupt the Site, its servers, or its networks
- Reproduce, duplicate, copy, sell, or resell any portion of the Site for commercial purposes without our written consent
- Use automated means (scrapers, bots) to access the Site in ways that burden our infrastructure
5. Intellectual property
All content on the Site — text, graphics, logos, code, screenshots, the EMPWRD Framework, and the EMPWRD name — is owned by Matt Toresco, LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual-property laws.
You may view, share, and reference Site content for personal, non-commercial purposes with proper attribution. You may not republish, redistribute, or build derivative products from Site content without our written permission.
6. Third-party links and services
The Site links to third-party websites and services — for example, the EMPWRD Patient app, AdvocateBridge, matttoresco.com, and our TEDx talk hosted on YouTube. We are not responsible for the content, privacy practices, or operations of those third parties. Their terms govern your use of them.
7. Your submissions
When you submit information through a Site form, you confirm that the information is yours to provide and that it does not violate any law or third-party right. You grant us a limited license to use that information for the purposes described in our Privacy Policy.
8. Disclaimer of warranties
The Site is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or virus-free. We do not warrant any specific results from using the Site.
9. Limitation of liability
To the maximum extent permitted by law, Matt Toresco, LLC and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site.
In jurisdictions that do not allow these limitations, our liability is limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend and indemnify Matt Toresco, LLC against any third-party claims arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including any violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Charleston County, South Carolina.
13. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after a change means you accept the updated Terms.
